Township Adopts Amendment to Ordinance No. 105, Burning Ordinance

As a result of requests from Township residents, Superior Township officials reviewed the existing Ordinance No. 105, Burning Ordinance. The second reading  and adoption of the amendments to the Burning Ordinance was completed on Tuesday, January 17, 2012. Below are copies of Ordinance No. 182 and Ordinance No. 105, as amended. Open fires are prohibited in Sections 33, 34 and 36 of the Township. In Sections 19 and 36, open fires are is only allowed under very specific circumstances related to farming activities.

Open fires are allowed in the remaining Sections of the Township, but you must obtain a burning permit from the Fire Department (call 734-484-1996). Residents who live in areas with nearby homes should be considerate of their neighbors and curtail any open fires. Smoke and open fires can create significant health and fire hazards.

ORDINANCE NO. 182

AN ORDINANCE TO AMEND ORDINANCE NO. 105-BURNING ORDINANCE

Please take notice that the second reading and adoption of Ordinance No. 182 –An Ordinance to Amend Ordinance No. 105-Burning Ordinance was made at the regular meeting of the Superior Charter Township Board of Trustees on January 17, 2012 at the Superior Charter Township Hall located at 3040 N. Prospect Road, Ypsilanti, MI 48198.

Ordinance No. 182 amends Ordinance No. 105 as follows:

Amend Section 105.03(1), Permissible Fires, by removing “section IV” and replacing it with “Section 105.04”.

Amend Section 105.03, Permissible Fires, by removing “beekeeping” and “; or burning for the control of crop disease provided the County agricultural agent has issued a permit for such burning”.

Amend Section 105.04(7), Regulations, so that it reads, “7. Due to the density and the danger of fires spreading and smoke and fumes creating a nuisance, no permits shall be issued for any location in Sections 33, 34 or 35 of the Township.”

Amend Section 105.04, Regulations, by adding Section 105.04 (8), as follows:

“8. Due to the density and the danger of fires spreading and smoke and fumes creating a nuisance, no permits shall be issued for any location in Sections 19 or 36 of the Township, except for burning of agricultural wastes as permitted by rules promulgated by the MDEQ or by State law.”

Amend Section 105.08. Effective Date; Publication, Updated this section to reflect the current Township policies for publication.

Publication of the Ordinance was made by posting in the Office of the Clerk, 3040 N. Prospect, Ypsilanti, 48198, and on the Township website – www.superior-twp.org – pursuant to Section 8 of the Charter Township Act, being MCL 42.8, 3(b).
